DEBT RECOVERY WITH SAFETRACK MEDIATION

SMALL CLAIMS COURT RESOLUTION PROTOCOL

BRAND NEW CONCEPT AND PROCESS - Restoring Certainty, Legal Protection, and Impartial Enforceability to Civil Claims up to £10,000 where the legal system and traditional mediation cannot

HOW DOES SAFETRACK MEDIATION PROVIDE THE REMEDY YOU NEED?

HOW IT WORKS IN REAL LIFE:
THE STORY OF THE UNPAID £9,000 and £3000 INVOICES

For many small to medium businesses a debt of £3,000 or £9,000 can be financially crippling to their cashflow. However, with the Small Claims Court not directly addressing cases lower than £10,000 the effect is a small business justice deficit.

The Problem: Trapped in the Small Claims Queue
Do you or someone you know run a local independent business? Although there is a very wide array of businesses on the Island and surrounding areas, I will use the example of a builders' merchant, an electrical wholesaler, or a trade supplier. You deliver £9,000 worth of premium building materials to a local contractor for a development project. The materials are used, the job is finished, but the contractor completely ignores your invoices. They screen your phone calls, avoid your credit team, and refuse to pay. It may also be a purchaser who may routinely abuse their contracted payment agreements.

Traditionally, your options are very limited. You instruct a solicitor, who charges you at least £350 an hour to write warning letters that get comfortably ignored. You then file a formal Small Claims court action. Because the court system faces a massive, gridlocked backlog, you are told you must wait up to 12 months just to get an initial allocation hearing. Worse still, the law now mandates that you must mediate which usually means attempting the court's free telephone mediation filter first. The debtor knows this loop and deliberately uses up the court's 1-hour phone call, spins out the 60 minutes with vague claims or excuses, and blocks the mediation track. The mediation fails, you have wasted months of time, and you are back at square one waiting for a trial while your cash flow evaporates. The debtor feels entirely safe.

The New Rule: Mediation as a Mandatory Court Gate
Previously, a claimant could log straight onto Money Claims Online (MCOL), pay a fee, and push their case directly into a trial queue without trying to settle first.
Under the new directives, mediation is now a completely mandatory, automated case-management step inside the County Court for all civil money claims under £10,000.
If a business files a small claim, the court will automatically halt the process and order both parties to engage in mediation.
• If you refuse to participate: The Judge can penalise you severely, strike out your claim, or refuse to award you your legal costs.
• If you do participate: You must use either the court's free (but heavily backlogged and strictly limited) 1-hour telephone service, or a local independent accredited provider like Isle of Wight Mediation. (See our IMCIP protocol on the website).

How You Secure the CCJ Faster Through Safetrack
Your 5-Day Settlement Engine does not bypass the County Court; it operates as the ultimate high-speed accelerator to secure that CCJ without the 12-month courtroom backlog.
Our system delivers the CCJ through two definitive paths:

Path 1: The Automated CCJ Entry (Upon Successful Agreement)
If the debtor enters your 5-day live vault and signs your Enforceable Settlement Contract, you have won. The small business owner takes that contract, uploads it straight to MCOL, and requests the court clerk to instantly enter it as an official, legally binding County Court Judgment (CCJ) on the terms agreed. You skip the 12-month trial queue entirely.

Path 2: The Rapid Default CCJ (Upon Debtor Sabotage)
If the debtor refuses to participate or ignores our Notice of Intent to Mediate, they have formally breached the new mandatory court direction. Safetrack Mediation hands the claimant our independent Certificate of Discontinuation due to Non-Compliance with the Data Log. The claimant uploads this certificate straight to MCOL. Because the Judge is handed digital proof that the debtor boycotted an independent mediator mandatory pre-action track, the Bench can effortlessly issue an immediate, rapid Default County Court Judgment (CCJ) against them on the spot.

Summary
Local independent businesses and solicitors can be 100% confident in our court aligned processes. The County Court Judgment (CCJ) remains the ultimate legal prize to enforce debt recovery under £10,000.
Our Safetrack Protocol, put simply, provides the fastest, safest, and most robust method to enforce the debtor to either sign that CCJ voluntarily in 5 days, or face an immediate default CCJ backed by our un-sabotageable digital Data Logs.

MEDIATION COMES OF AGE IN RESPONSE TO THE DAWN OF NEW COURT MANDATES

New and innovative solutions are provided exclusively by Isle of Wight Mediation. They are designed to give organisations and individuals legal protection and enforceability that is not presently easily available either within the legal justice system or within mediation.

Independent mediation natively carries an 85% to 95% initial success rate, and we have made that statistical foundation stronger by being strictly court aligned creating solutions that are deeply sustainable and designed to bring rapid, final resolution.

The resulting court changes have inevitably created a hole where justice for the small business is hard to fill. It has become an invisible tax on cash flow. Under the current UK civil justice framework, thousands of small business owners, trade suppliers, and independent contractors are being systematically squeezed out of the legal system. When an invoice between £1,000 and £10,000 goes unpaid, the business owner faces an impossible dilemma. Debt recovery is slow and can be expensive, so the business faces the option of simply writing the debt off. Traditional debt collection agencies are toothless, frequently trapping traders in multi-year "£5-a-week" nominal payment plans that sometimes cost more to administer than the debt is worth.

THE DECEPTIVE COSTS OF TRADITIONAL DEBT COLLECTION

Many independent businesses turn to traditional debt collection agencies out of desperation, believing their "No Win, No Fee" models are risk-free. The reality is often a severe drain on your corporate capital:
• The Commission Strip: Agencies routinely charge between 15% and 50% of the recovered debt as an internal fee. If they recover your £9,000, you could lose up to £4,500 of your own hard-earned capital simply to clear the file.
• The £5-a-Week Delay: Traditional agencies hold zero statutory power. If a rogue contractor offers a nominal, low-value payment plan to smooth their own cash flow, the agency may likely force you to accept it, dragging your invoice out for months or years while your cash flow bleeds out.
• The Immediate Safetrack Difference: Isle of Wight Mediation can work as a cost effective and rapid alternative solution to address debtors and non-payments affecting your cashflow. Our fee does not clip your principal debt as it is structured to make financial sense. Our fixed, transparent fees are fully equalised between participants and arrangements between participants may also be agreed. Should the debtor act in bad faith and attempt to disrupt or ignore the timebound windows or the terms of the mediation, our £1,999 Case Disruption Levy is legally fused onto the claimant’s debt and the face of their court judgment. Because of our structured documents and Data Log, the Judge can order the defaulting debtor to pay for your entire recovery, ensuring your business cash flow is robustly protected at 100% value. This article describes how that works.
• The Symmetrical Resolution Shield: What stands as a marked difference in our process and heavily contributes to its success, is that both participants are provided with equal opportunity to be heard and provide documented proof of their financial position and contribute equally to the solution within a chronological framework. There are however, conditions that must be followed. The Claimant is entirely free to determine their terms of an agreement which are then considered and negotiated with the debtor within a strict structure, to go on to form a mutually agreed contract. This is achieved with a process that is swift, disciplined and highly structured. This balanced architecture results in a significantly stronger agreement and a deeper commitment to a long-term resolution. The structured architecture and process protects each participant, providing a safe, completely confidential, neutral and impartial environment that produces a strong, sustainable solution for all participants.

THE TURNAROUND: ENTERING THE SAFETRACK 5 WORKING DAY SHIELD

Instead of being at the mercy of non-paying individuals or organisations, or a legal process that fails the small business, you activate the Isle of Wight 5 working day Safetrack for a scaled fixed fee of £700 or £950 with no hidden costs.
Our mediation office immediately delivers a formal Notice of Intent to Mediate directly to the participants and their instructing solicitors, if a solicitor has been engaged. This Notice is accompanied by the Terms of Engagement, providing clarity of the structure within which the mediation will operate. It puts the invited participant on notice of the mediation and activates timebound windows. The Safetrack system ensures your business wins either way so that participants can be sure that whether or not a participant co-operates with the terms of the mediation, a compliant participant will walk away with court aligned documents that support a future application for summary judgement or costs to the court in your favour.

It is recognised that not only can a debtor can be an individual but also a large organisation that does not comply with contractual payment terms putting immense pressure onto a small business. Here are the only two paths the debtor can now take:

PATH A: THEY COMPLY (You Secure an Enforceable Court Order in 5 Days)
As avoidance is no longer an option due to the Court mandated requirements, the invited participant boards the mediation track. Because our system is strictly a 1-to-1 private shuttle framework, added attrition, stress and protracted argument are avoided as there is never a need to meet face to face. In this system, the mediator manages the timeline and the process.
Information to be mediated requires relevant informative documents to be disclosed and must be submitted 7 days ahead of the mediation start date. The facilitates the 5-day negotiation windows to progress cleanly and swiftly, flowing through a chronological mediation process. Within 5 days, a final agreement is reached.
The agreement forms a robust Settlement Contract engineered specifically for your solicitor or internal credit team to promptly lock into a Court Order as is required or appropriate.
If a participant, which in this case will be a debtor, fails to adhere to the terms of the agreement, such as pay on the agreed date, you don't go back to court. You can bypass the litigation queue and transfer the file straight up to the High Court for Enforcement because the participant default has incurred our £1,999 default levy along with the Certificate of Default. If your debt is £9000, it is now contractually fused with the levy and is £10,999. This facilitates entry into High Court Enforcement.

PATH B: THEY DO NOT COMPLY AND TRY TO STALL (The £1,999 Safetrack Default Deterrent)
Let's say the debtor thinks that they can continue with their usual conduct surrounding non-payment believing there is nothing that can be done, perhaps where a small business cannot financially commit to chasing a large organisation for their unpaid bills. The invited participant ignores the Notice or tries to drop a big file of unverified complaints to block the track.

When a rogue debtor owes money, a favourite tactic to avoid paying can be to manufacture a sudden, unverified complaint on the spot, such as claiming "the building supplies were defective" or "the workmanship was poor." In the traditional court system, this simple lie works beautifully: it freezes the collection and forces the business into a 12-month legal battle to prove the debtor is lying. Instead of getting bogged down dealing this, the Safetrack mediation framework intercepts these behaviours in both cases.

Silence is logged onto the file’s Data Log records, with date and time. When a court aligned Certificate of Default or Discontinuance is issued, the factual Data Log is included. Conduct by the participant that produces unverified complaints, is filtered out by our framework preventing admission of the claims to the mediation. An official fake dispute filter (Form UPA-1) is issued describing failure to provide independent professional proof that verify their claims. The Safetrack framework promptly produces a multiple response directly to the participants and if instructed, their solicitors.

1. The official fake filter (Form UPA-1) is issued and contractually discards unverified complaints.
2. Certificate E (Notice to Rectify) opens a final, strict 7-day window inviting a non-compliant participant to co-operate to prevent mediation collapse. It is now considered significant by a Judge if a participant does not co-operate where mediation is offered, which makes the invitation to rectify non-compliant actions an important protection for both participants, particularly as every event within the file is recorded within the Data Log which is admissible into court.
3. Simultaneously, a Case Disruption Levy Penalty Invoice of £1,999 is added onto the claiming participant’s debt. None of this is a surprise or covert action. These terms are clearly detailed within the Terms of Engagement delivered with the Notice of Intent to Mediate, providing each participant with full and transparent information to obtain a successful mutual outcome and prevent escalation.

The £9000 debt is now a total dispute amount of £10,999. This automatically takes the case out of the Small Claims track and transitions it into the court's strict, cost-bearing Fast-Track network. It forces the case into a court tier where a person can be legally ordered by the Judge to pay 100% of the private solicitor bills and mediation fees on top of the original debt. A £9,000 row could now land them with a £25,000 courtroom bill. Safetrack mediation provides both parties with the opportunity to prevent this stress and additional costs and work to create resolution. Real life can complicate matters and this will be heard, enabling a path forward through the highly structured framework. However, for a bad faith party, this system provides the legal teeth for action and resolution where the current legal system and mediation cannot.

If a non-compliant participant fails to rectify within 7 days of a Notice to Rectify, the track collapses, and we issue a formal Certificate of Discontinuance due to Non-Compliance. A Completion Pack containing these documents, is delivered to the participants and their solicitors. The solicitor doesn't need to prepare for a long, expensive trial. They can file for a rapid Summary Judgment Application (CPR Part 24), attaching the Completion Pack with our independent Data Log as factual proof. The Judge can easily see our record, sees where a participant deliberately sabotaged an accredited independent ADR offer, and is able to immediately issue a final Judgment for the full £9,000, which now includes the £1,999 penalty, and orders the debtor to pay 100% of your wasted legal bills and track fees on a full indemnity basis.

Further protection is provided through Safetrack mediation. Whether or not the case transitions into a High Court matter, the terms of an agreement reached are a valid binding and enforceable contract engineered specifically to be immediately rubber-stamped into a sealed court order.

If a participant defaults on any terms of the agreement, the Safetrack mediation office should be promptly notified by email so that the breach can be logged onto the file’s Data Log. This notification sets off an administrative response and issues an official Post-Mediation Certificate of Default with the £1,999 Case Disruption Levy Penalty Invoice. This is promptly delivered to the participants and instructing solicitors. This contractually fuses the penalty directly onto your debt, giving your legal advisors the independent paperwork required to promptly bypass standard courtroom trials.

WHAT IF MY OUTSTANDING DEBT IS SMALLER, SAY £3,000 OR £5,000? DOES SAFETRACK STILL HELP ME?

We recognise that spending £950 per person to chase £3,000 does not make the same financial sense as investing that sum for a debt of £6,000 or £9,000. To protect our local independent business network from being economically squeezed out of the justice system, our Mediation Office operates a Proportional Invoice Tier specifically tailored for active civil debts £5,000 or under:
• The Smaller Claims Pricing Adjustment: For debts £5,000 or under, our standard fee is scaled down to a flat, accessible rate with a deposit of £250 per person which facilitates the sending of a Notice of Intent to Mediate inviting the other party to join a mediation and set a date. The Notice to Mediate has significant weight as the Courts no longer tolerate seeing a case before them where a party has refused mediation.
• The Protected Initiation Deposit: Your deposit activates the file and the despatch of the formal Notice of Intent along with the Terms of Engagement and an invoice for the Smaller Claims Track of £700. Under our protective First-Mover Billing Protocol, your remaining balance is placed on absolute administrative stay with £0 due. You do not pay your balance until and unless the debtor's / invited participant’s payment has physically cleared our Safetrack mediation office.
• What Happens If the Debtor Simply Refuses to Pay or Claims They Have No Funds? If the 14-day window expires and the debtor ignores the Notice of Intent to Mediate or refuses to clear their intake fee, you do not lose further operational funds.
• The Deposit covers production of further legal evidence at no extra cost on all Safetrack Mediations where a participant has refused to co-operate with a mediation. In this case, the Safetrack Mediation Office moves to terminate the mediation track and delivers a formal Certificate of Default with Notice to Rectify, giving a further 7 day opportunity to join the mediation. Further silence and non-compliance will result in an issue of a Certificate of Discontinuance due to Non-Compliance delivered to both participants and their solicitors if they are instructed. Your initial £250, of £350 deposit, is fully preserved and is working hard throughout the process. You do not need to hire expensive solicitors or barristers. You simply upload each certificate directly to the government’s online Money Claim portal yourself.

ACHIEVING AN ORDER OR JUDGEMENT WHETHER OR NOT THE INVITED PARTY CO-OPERATES:

Because our independent Data Log and Certificates provide the reviewing Judge with absolute, digitally verified proof that the debtor deliberately sabotaged an accredited ADR offer, the court can immediately issue a rapid default judgment against them without requiring further proceedings or a drawn-out trial.

Your solicitor can include your £250 (or £350) deposit and any further fees or costs, directly onto the court judgment form. The Judge can order the debtor to directly reimburse you for those out-of-pocket expenses alongside your £3,000 principal debt, making our track 100% risk-free and fully recoverable.

THE OUTCOME: COMPLETE CASH-FLOW PROTECTION

Whichever path the debtor chooses, and whatever the size of your debt, your company capital is robustly insulated. If they cooperate, you obtain an agreement and payment arrangement in 5 days. If they default, they incur court-enforceable documentary evidence that may result in the enforcement of your debt plus an entire bill for recovery, to include your initial fees, penalty invoices and any further costs.
Safetrack stops the stalling and puts you back in absolute control of your cash flow.

HIGH-VALUE CIVIL & COMMERCIAL CLAIMS OVER £10,000
Deploying the 14 and 31-Day Safetrack In High Value Commercial Cases

Commercial Environments have a wide range of complex situations that result in financial claims. These may include Breach of Contract, Commercial Failure, Professional Negligence, and Business Partnership split to mention but a few.
Where a commercial dispute, failed construction contract, supply-chain breach, or professional negligence claim exceeds the £10,000 threshold, the stakes shift dramatically. The dispute enters the court's strict, cost-bearing Fast-Track or Multi-Track circuits, where unmanaged litigation can easily drag on for at least 18 to 24 months, bleeding your corporate cash flow and incurring devastating, uncapped legal fees.
While standard civil and commercial mediation often brings a successful resolution in that it can result in a satisfactory agreement, traditional methods have a structural weakness providing no protection from bad faith actions and limited protection from non-compliance to an agreement and thus can lack the ingredients for a long term, sustainable solution that results in either a return to mediation or the commencement of legal proceedings. You are left out of pocket despite great efforts at resolution, and there is weak leverage for fresh mediation or legal proceedings and now you are faced with the enormous court backlog and the costly, stressful task of developing your case. The advanced 14 and 31 day Safetrack addresses each of these issues.

THE ADVANCED SAFETRACK INTERVENTION

Our premium 14-Working-Day and 31-Working-Day Safetrack upgrades your commercial security entirely by replacing protracted attrition with structured, court-integrated systems architecture.

Designed explicitly to handle high-friction, high value settlements. In commercial environments there are often dense corporate asset pools, with complex interconnected financial assets, structures and liabilities, or indeed as may be within a high net worth inheritance or family separation dispute.

Safetrack contractually enforces an absolute timeline from commencement to finality:
• Pre-Disclosure Audit: Prior to the secure vault negotiations commencing, both participant positions must pass our strict Three-Part Ingestion Audit Trail. All financial disclosures, expert opinions, and contract specifications must be symmetrically disclosed and pre-validated. Any attempt to introduce unverified counter-claims or tactical mud-slinging is filtered in the audit, and if not verified, it is struck out via Form UPA-1 and barred from admission to the mediation.
• The Graded Escrow Vault Lock: Once pre-validated, the dispute enters our live Chronological Escrow Vault Window. High-value portfolios or multi-layered contract failures utilise our Complex Estate Multi-Property (MPX) Protocol, expanding the live negotiation window up to 15 or 20 working days. (See our Safetrack costs page on the website for details of additional fees). Formation of the Agenda defines the items to be mediated and these are entered into the secure escrow vault blocks. A block may have an independent breach or group of breaches, certain invoices, an asset or asset class, which will receive its own 48-hour negotiation window. Terms are sequentially negotiated and locked permanently into the escrow vault.
• Immediate High-Court Enforcement Vector: A successful Safetrack Mediation yields a robust, contractually locked Settlement Contract formatted specifically for your legal advisors to instantly convert into a binding court order such as a Chancery Tomlin Order or a Court Consent Order. This completely bypasses the trial queue and expensive financial directions hearings. It grants your company rapid authority to enter High Court protocols such as where you may deploy High Court Enforcement Officers (Bailiffs) to execute a Writ of Control, freeze commercial accounts or operating assets, order a sale, split accounts, all within days. This may still occur if a milestone or term is breached because of the documented Data Log and factual Certificates.
• Capital Insulation Against Mediation Sabotage: Should a participant attempt to ignore timebound windows or act in bad faith, the track moves to permanently close whilst giving the defaulting participant every opportunity to rectify. The Safetrack administration structure attaches an enforceable £1,999 Case Disruption Levy Penalty Invoice to the debt and a Certificate of Default and Notice to Rectify, which gives a further 7 days to rectify. If this time expires without rectifying, Safetrack issues a court-ready Certificate of Discontinuance due to Non-Compliance. This Completion Pack of documents, including the Data Log, is sent to the participants and their instructing solicitors. This independent digital Data Log of sequential, dated facts and events provides the reviewing Judge with proof of the sabotage, enabling your legal advisors to secure a summary strike-out of the defaulting participant’s defence and obtain an Adverse Costs Order on a full indemnity basis, forcing the non-compliant participant to pay 100% of your wasted legal bills and track fees.
